POTENTIAL VIOLATION OF COLORADO'S "STANDARDS OF CONDUCT" LAWS


CompleteColorado.com is first to report that Weld County D.A. Ken Buck is reviewing claims that Barb Kirkmeyer, a Republican candidate for Weld County Commissioner, violated Colorado's "Interest in Contracts" law.

That law states:
Members of the general assembly, public officers, local government officials, or employees shall not be interested in any contract made by them in their official capacity or by any body, agency, or board of which they are members or employees. A former employee may not, within six months following the termination of his employment, contract or be employed by an employer who contracts with a state agency or any local government involving matters with which he was directly involved during his employment.
This is also sometimes referred to as the "revolving door" ethics clause.

Kirkmeyer was dismissed by the incoming Ritter administration, and her service at the state's Department of Local Affairs (DOLA) came to an end on July 1st, 2007.

Her tenure with DOLA was not without its own controversy, however....

The following documents show that in the weeks immediately following her termination, Kirkmeyer made her services available to the City of Ft. Lupton to help them secure DOLA grants.

EXAMPLE ONE:

Roughly two-and-a-half months after leaving DOLA, Kirkmeyer offered her grantwriting services to the City of Ft. Lupton. The document clearly indicates Kirkmeyer will be compensated based on successful grants. Furthermore, the minutes indicate that Kirkmeyer had incentive to make certain that the grants were over a certain dollar amount.

EXAMPLE TWO:

Nearly one month later, documents show Kirkmeyer's general offering of grant-writing services had then become one of writing grant proposals to her former employer, the Department of Local Affairs.

EXAMPLE THREE:

A check register from the City of Ft. Lupton shows that on or about November 7th of that same year, Ft. Lupton cut a check to Kirkmeyer for her successful grant proposals.

All of this appears to have been transacted within the first six months of Kirkmeyer's dismissal from DOLA.
